Terms of Service

The agreement between your business and AVIT.DEV Software Development Services for using Tumblo. Plain words, no surprises.

1. Who we are

Tumblo is a laundry shop management platform operated by AVIT.DEV Software Development Services ("AVIT.DEV", "we", "us"), based in the Philippines. These Terms of Service ("Terms") are an agreement between AVIT.DEV and the person or business using Tumblo ("you").

They cover the Tumblo website at tumblo.app, the Tumblo web application, the free tools we publish, and any support we give you. For anything about these Terms, write to legal@tumblo.app.

2. Accepting these terms

By creating a Tumblo account, signing in, or using any part of the service, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of a business, you confirm that you are authorised to bind that business, and "you" then means that business.

If you do not agree with any part of these Terms, do not use Tumblo.

3. Your account

You need an account to use Tumblo. Sign-in is handled by our authentication provider, and you are responsible for keeping your credentials private.

  • You must be at least 18 years old and legally able to enter into a contract.
  • The details you give us — your name, email address, store name, and store address — must be accurate and kept up to date.
  • Do not share one login between people. Invite each person their own account instead.
  • You are responsible for everything done under your account, including by staff you invite.
  • Tell us at security@tumblo.app right away if you think someone has accessed your account without permission.

4. Stores, staff, and roles

Tumblo is organised around stores. The account that creates a store is its owner, and the owner decides who else gets access and what each person can do.

  • Owners can invite co-owners, staff, and couriers by email, and can remove that access at any time.
  • Each role sees only the screens and data its permissions allow. Choose the role that matches what the person actually needs.
  • The owner is responsible for the conduct of everyone they invite, and for removing access when someone leaves the business.
  • If your business has more than one branch, each store is set up, billed, and limited separately.

5. Plans, billing, and renewals

Tumblo has a free plan and paid plans. Paid plans are priced per store in Philippine pesos and can be billed monthly or yearly. Current prices and what each plan includes are shown on our pricing page, which forms part of these Terms.

  • Paid plans renew automatically at the end of each billing period until you cancel.
  • Payments are processed by our payment provider. We never see or store your full card details.
  • Cancel any time from your billing settings. Cancellation takes effect at the end of the period you have already paid for, and we do not pro-rate partial periods.
  • Prices may change. We will tell you at least 30 days before a change affects a renewal, and you may cancel before it takes effect.
  • Fees exclude taxes where taxes apply. If a payment fails, we may downgrade the store to the free plan after notifying you.
  • Downgrading to the free plan keeps your data but re-applies the free plan limits, so some features stop accepting new records.

All fees are non-refundable, including for partial billing periods and for time you did not use. Cancelling stops the next renewal; it does not refund the period you are already in. The one thing we return is money taken in error — a double charge, or a charge after you cancelled. Email support@tumblo.app within 30 days and we will correct it.

6. SMS credits and messages

Some features send text messages to your customers, such as ready-for-claim notices and campaigns. These messages consume prepaid SMS credits bought through Tumblo and delivered by a third-party Philippine SMS provider.

  • Credits are consumed when a message is accepted for delivery, whether or not the recipient reads it.
  • We cannot guarantee delivery or timing, because that depends on the mobile networks.
  • Credits are non-refundable, are not exchangeable for cash, and cannot be transferred to another business — including any credits still unused when you stop using Tumblo.
  • You are responsible for the content of the messages you send and for having a lawful basis — usually the customer's consent — to contact them, as the Data Privacy Act requires. Do not use Tumblo to send advertising to people who have not agreed to receive it.

7. Acceptable use

Use Tumblo to run your laundry business, and nothing else. You agree not to:

  • Break any law, or use Tumblo to store or send unlawful, deceptive, or abusive content.
  • Try to access another business's data, or probe, scan, or test our systems without written permission.
  • Interfere with the service, get around usage limits, or send automated traffic that degrades it for others.
  • Copy, resell, sublicense, or white-label Tumblo, or reverse engineer any part of it except where the law says you may.
  • Upload malware, or upload personal data you have no right to process.

If you find a security problem, report it to security@tumblo.app rather than exploiting it. We will not bring a civil claim against good-faith research that follows that route, stays inside your own store's data, and does not disrupt the service. We cannot waive the rights of other people, or anything the State may pursue on its own under the Cybercrime Prevention Act.

8. Your data

Everything you record in Tumblo — your orders, customers, payments, expenses, inventory, and settings ("Store Data") — belongs to you. We claim no ownership over it.

You grant us the limited permission to host, process, back up, and transmit Store Data for the purpose of running the service for you, keeping it secure, and giving you support. We do not sell it, and we do not use the contents of your Store Data to advertise to your customers.

When your Store Data includes information about your own customers, you are the personal information controller for that data and we act as your processor. You are responsible for collecting it lawfully and for telling your customers how you use it. Our Privacy Policy explains how we handle it on your behalf.

You can export your records from within the app while your account is active. Do this before you cancel.

9. Availability and changes

We work to keep Tumblo available and fast, but we do not promise uninterrupted service. Maintenance, provider outages, and problems outside our control can interrupt access.

  • We may add, change, or remove features. If a change materially reduces a feature you rely on, we will give reasonable notice.
  • We may set fair-use limits to protect the service for everyone.
  • Beta or preview features are offered as-is and may change or disappear without notice.

10. Third-party services

Tumblo runs on top of third-party providers for hosting, database, authentication, payments, and SMS delivery. Their handling of data is covered in our Privacy Policy. We choose these providers carefully, but we are not responsible for their own outages or acts. If you connect Tumblo to any other service you use, that service's terms apply to it, not ours.

11. Our intellectual property

Tumblo, its software, design, brand, and the Tumblo name and logo belong to AVIT.DEV. These Terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Nothing here transfers ownership of our intellectual property to you.

If you send us feedback or feature ideas, we may use them without obligation or payment to you.

12. Suspension and termination

You can stop using Tumblo and close your account at any time. We may suspend or terminate access if you breach these Terms, if your payment stays unpaid, if we are required to by law, or if your use puts the service or other customers at risk.

Where the situation allows, we will warn you first and give you a chance to fix it. After an account is closed, we keep Store Data for 30 days so you can ask for a copy or change your mind, then delete it on the schedule described in our Privacy Policy.

13. Disclaimers

Tumblo is provided "as is" and "as available". To the extent Philippine law allows, we give no implied warranties, including any implied warranty of fitness for a particular purpose or against hidden defects. We do not disclaim anything the law does not let us disclaim.

Tumblo helps you record and read your numbers; it is not accounting, tax, or legal advice. What it prints is a job order — the record of what your customer brought in and the stub they keep to claim it. Tumblo is not a BIR-accredited point-of-sale or computerised accounting system, so a job order is not an official receipt or a sales invoice, and you still issue those to your customer yourself.

Your books, your filings, your permits, and any record you are required to preserve stay your responsibility. Keep your own copies, and export what you need from Tumblo before you close your account.

14. Limitation of liability

To the fullest extent allowed by Philippine law, AVIT.DEV is not liable for lost profits, lost revenue, lost or corrupted data, business interruption, or any indirect, incidental, special, or consequential damages arising out of your use of Tumblo.

Our total liability for any claim relating to Tumblo is limited to the fees you paid us for the affected store in the 12 months before the event that gave rise to the claim.

Philippine law does not allow a waiver of liability for future fraud, and we do not attempt one. This limit does not apply to fraud, bad faith, gross negligence, or willful misconduct, and it does not touch any right your own customers have under the Data Privacy Act.

15. Indemnity

If someone brings a claim against us because of your Store Data, the messages you send your customers, or your breach of these Terms or of the law, you agree to cover the resulting losses and reasonable legal costs. We will tell you about the claim promptly, let you take part in defending it, and will not settle it without your agreement.

16. Changes to these terms

We may update these Terms as Tumblo changes. When we make a material change, we will update the date at the top of this page and notify you by email or inside the app before it takes effect. Continuing to use Tumblo after that date means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Any dispute that cannot be settled amicably will be brought exclusively before the proper courts of the Philippines.

If any provision of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision at one time is not a waiver of it.
